Underage DUI in RI: The Extreme Case
Rhode Island enforces a zero-tolerance BAC threshold of 0.02% for drivers under 21 — meaning even a single drink, or sometimes residual alcohol from a recent drink several hours earlier, can trigger a per se DUI violation. The 0.02% Zero-Tolerance Threshold
RIGL § 31-27-2 sets three separate per se BAC thresholds:
- Standard drivers age 21+: 0.08%
- Commercial drivers (CDL): 0.04%
- Drivers under 21: 0.02%
The 0.02% level is essentially "any detectable alcohol." It is set just above the false-positive floor for the breath testing equipment. A single 12-oz beer can produce a BAC measurably above 0.02% in a driver under typical body weight.
Underage DUI Penalties
For drivers under 18, special enhancements apply that are different from the adult misdemeanor framework. For drivers 18 to 20, penalties largely follow the adult first-offense framework:
- Fine: $250 to $500
- License suspension: 1 to 3 months for a first offense; longer for repeat or higher BAC
- Mandatory alcohol education program
- Community service: 30 to 60 hours
- Possible ignition interlock at higher BAC tiers
If the underage driver's BAC was at or above 0.08%, the case is treated under the standard adult DUI framework with adult penalties.
The Bigger Picture — Beyond Statutory Penalties
Campus Discipline
A DUI arrest typically triggers a campus conduct review at most colleges. Rhode Island institutions vary in severity, but consequences can include probation, suspension, loss of housing, and disqualification from athletics or leadership positions.
Financial Aid
The federal aid disqualification for drug-related convictions was eliminated in 2021, but state scholarships and athletic scholarships frequently include character clauses. A DUI conviction can result in loss of merit-based aid.

- Challenge the stop. The officer needed reasonable suspicion. Pulling out of a parking lot late at night without observed violation may not meet the standard.
- Challenge field sobriety tests. NHTSA-standardized administration is required. Roadside conditions, lighting, and officer training all affect validity.
- Challenge the breathalyzer at 0.02%. The margin between 0.00% (no alcohol) and 0.02% (per se violation) is small enough that calibration and operator factors can produce false positives.
- Negotiate a reduction. Reckless driving (§ 31-27-4) is a typical first-offense reduction target that avoids the DUI conviction record.
- Document medical conditions. Diabetes, GERD, certain medications, and recent dental work can produce false-positive BAC readings.
